Tariff of Remuneration to Authors for the Use of Musical Works via Technical Devices

This Tariff is used to calculate remuneration to authors for the use of copyright-protected musical works through communication to the public by means of technical devices (e.g. radio or TV receiver, CD/DVD/Blu-ray player, jukebox, PC, tablet, smartphone, etc.) in commercial premises, service establishments, or other facilities (such as hospitality establishments, accommodation facilities, recreational establishments or complexes, shops, service providers, vehicles, etc.).
 

Music for listening purposes (without dancing), reproduced by means of technical devices (excluding jukeboxes)


An audio receiver or player (radio, CD player, PC, etc.):

  • in a hospitality establishment (restaurant, canteen, pub, tavern, buffet, taproom, café, bistro, coffee shop, patisserie, wine bar, bar, etc.)
  • in the common area of an accommodation establishment (hotel, motel, botel, guest house, hostel, etc.) or medical establishment with accommodation
  • in the accommodation area (guest room) of an accommodation establishment (hotel, motel, botel, guest house, hostel, etc.) or medical establishment with accommodation


An audiovisual receiver or player (television set, video player, PC, etc.):

  • in a hospitality establishment (restaurant, canteen, pub, tavern, buffet, taproom, café, bistro, coffee shop, patisserie, wine bar, bar, etc.)
  • in the common area (lobby, lounge, etc.) of an accommodation establishment (hotel, motel, botel, guest house, hostel, etc.) or medical establishment with accommodation
  • in the accommodation area (guest room) of an accommodation establishment (hotel, motel, botel, guest house, hostel, etc.) or medical establishment with accommodation


Large screens in hospitality establishments and outdoor areas

  • Music reproduced by any technical device:
     
    • in an elevator or toilets
    • in a sports stadium
    • in a recreational establishment or complex (swimming pool, skating rink, winter sports complex, etc.)
    • in a permanent store (including department stores and shopping centres)
    • at a petrol station
    • in museums, galleries, and non-commercial art or educational exhibitions
    • on the premises of regularly recurring sales events (markets, etc.)
    • on buses, in taxis and rental cars, in other means of land passenger transport (trains), and on aircraft
    • in a service establishment (hairdressers, beauticians, manicure and pedicure salons, saunas, repair shops, travel agencies, betting shops, etc.)
    • in waiting rooms, lobbies, and reception areas during the provision of services
    • in large-capacity garages and car parks
    • in establishments offering selected special services (erotic salons, peep shows, etc.)
    • in casinos, etc.
    • via mobile advertising equipment (promotional vehicles with loudspeakers, etc.)
    • over the telephone from a local telephone exchange
    • via a paid audiotext music line or as part of other paid audiotext services
    • via local radio (used for announcements, greetings, etc.)
    • on school radio (break-time programming)
    • via any technical device at fairs or amusement parks (carousels, shooting galleries, slides, bumper cars, etc.)
    • and other similar uses
       
  • Music from jukeboxes
     
  • Music from digital (e.g. MP3) jukeboxes (reproduction and public performance of musical works), for listening purposes only
